RetroLens Terms of Use

You must be at least ages 13 and up years old to use RetroLens. If you are under the age of majority in your jurisdiction, you must have permission from a parent or legal guardian to use the Services. See also the AI features are intended for users 17 and older; other features are available at the App Store age rating.

You create or sign in to RetroLens using Sign in with Apple, Sign in with Google, or email and password. Email accounts support email verification and password reset. You agree to:

• provide accurate profile information and not impersonate anyone
• keep your sign-in credentials and device secure
• be responsible for activity under your account
• notify us if you believe your account has been accessed without authorization

We may suspend, restrict, or terminate accounts that violate these Terms, create risk for the Services or other users, or are involved in suspected abuse, fraud, or illegal activity.

RetroLens is licensed, not sold, to you. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use RetroLens on Apple-branded devices that you own or control, as permitted by Apple's Usage Rules and the App Store Terms of Service, for your personal, non-commercial use.

You must comply with applicable third-party terms when using RetroLens, including Apple's App Store terms, your wireless data service agreement, and any terms that apply to third-party services you choose to use with RetroLens.

RetroLens lets you:

• capture photos in the in-app camera and import photos from your device
• apply G7X-style processing to your photos
• optionally use G7X AI Look, an optional feature that sends a photo you select to Google's Gemini AI for processing (see the "G7X AI Look" section below)
• post photos to your Circle of accepted friends
• maintain private memories and saved items
• send and accept friend requests, comment, react, block, and report
• send invites through your device's native share sheet
• purchase an optional auto-renewable subscription ("RetroLens Pro") and optional consumable "G7X AI Look" credit packs where available

Your Circle is your set of accepted friends. RetroLens does not currently include a public feed or public-profile discovery system. Your private memories and saved items are private to you and don't change the visibility of your posts.

RetroLens is built for private, respectful sharing with people you actually know. To keep RetroLens safe, you can report content or accounts, block users, and contact us at team@getbananaapps.com. We may remove content, restrict features, or suspend or terminate accounts that violate these rules.

You agree to use the Services only in a lawful, safe, and respectful manner. You may not:

• violate any law or regulation
• impersonate another person or misrepresent your identity
• upload or share content that is illegal, abusive, harassing, hateful, threatening, fraudulent, sexually exploitative, non-consensually intimate (including "revenge porn"), self-harm related, or otherwise harmful
• upload, share, request, or solicit any sexual content involving minors, or any content that sexualizes, exploits, or endangers minors — strictly prohibited and reported to authorities where required by law
• harass, bully, threaten, stalk, or intimidate other users
• post threats of violence or content promoting violence, terrorism, or serious harm
• infringe another person's intellectual property, privacy, publicity, or other rights
• spam other users or engage in coordinated inauthentic behavior
• scrape profiles, search results, or other data
• bypass rate limits or attempt to overload our infrastructure
• reverse engineer, decompile, disassemble, or copy the Services except as permitted by law
• attempt to gain unauthorized access to the app, servers, accounts, or data, or perform unauthorized security testing
• use bots, scrapers, crawlers, automation, token abuse, or upload abuse
• interfere with or disrupt the operation or security of the Services

You retain ownership of your User Content — the photos, captions, comments, reactions, profile content, private notes, and other content you submit through RetroLens.

You grant Banana Apps LLC a limited, non-exclusive, worldwide, royalty-free license to host, store, process, display, transmit, and reproduce your User Content only as reasonably necessary to operate RetroLens, deliver content to the people you choose, maintain safety, troubleshoot bugs, and enforce these Terms. This limited operational license includes transmitting images or other User Content you select for optional AI processing to the third-party AI processor (currently Google Gemini) solely to provide the feature you requested.

We do not claim ownership of your User Content, and we do not claim ownership merely because it has been processed by G7X AI Look or another automated feature. We do not sell your private photos and we will not use your private posts in advertising or public marketing without your permission.

You represent and warrant that:

• you own or have the necessary rights to your User Content, including any rights of people who appear in your photos
• your User Content does not violate these Terms, any law, or the rights of any third party

You are solely responsible for the content you post and how you use the Services.

G7X AI Look is an optional feature that processes an image you select using a third-party AI service (currently Google Gemini). By using G7X AI Look you understand and agree that:

• The image you select will be uploaded to our private storage and transmitted to the third-party AI service to produce a result, as described in the Privacy Policy.
• You must have the right to submit the image, including any necessary rights or permissions of people who appear in it.
• AI outputs may be inaccurate, unexpected, lower quality than expected, or visually alter parts of an image (including faces, text, hands, or backgrounds). You should review results before saving, downloading, or sharing them.
• We do not guarantee any particular quality, style, likeness, accuracy, uptime, or availability of AI outputs. Purchasing AI credits does not guarantee a particular creative result.
• The feature is subject to safety and abuse restrictions. We may reject or interrupt processing for safety, abuse-prevention, technical, capacity, content-policy, or legal reasons.
• The feature may be temporarily unavailable, delayed, degraded, rate-limited, or interrupted because of third-party provider failures, model changes, network conditions, or maintenance.
• We may change, upgrade, downgrade, replace, or discontinue the underlying AI model or the feature itself. Where we do so, we will handle purchased credits fairly and subject to applicable law.
• You are responsible for how you use AI outputs, including whether you post them to your Circle or share them outside RetroLens.

RetroLens includes private social features such as profiles, friend requests, comments, reactions, invites, blocking, and reporting. You understand and agree that:

• posts you share are intended for your Circle of accepted friends
• recipients may screenshot, screen-record, or otherwise capture content they can see — no privacy system is perfect
• you may block other users and report content or accounts (for spam, harassment, impersonation, sexual content, fake accounts, or other reasons)
• we provide reporting and blocking tools and a support contact at team@getbananaapps.com
• we aim to act on credible reports of objectionable content or abusive users in a reasonable timeframe and may remove content, restrict visibility, suspend features, or terminate accounts
• we may investigate suspected abuse, spam, harassment, fraud, impersonation, or other misconduct
• repeat offenders and accounts involved in serious violations (such as content sexualizing minors, non-consensual intimate imagery, threats of violence, or coordinated harassment) may be permanently banned and reported to the appropriate authorities

We may use automated, manual, and user-report-based tools to detect, filter, restrict, or remove objectionable content, abusive behavior, spam, impersonation, or violations of these Terms. This may include filtering of usernames, bios, comments, and other text surfaces.

Moderation is not perfect. We do not guarantee that all objectionable, harmful, or violating content will be detected, prevented, or removed before another user sees it. You use the Services with that understanding.

Prior access cannot be undone. Blocking a user, unfriending, removing content, or deleting your account does not undo screenshots, screen recordings, prior views, external shares, downloads, or copies that other users may have made or saved outside RetroLens.

We may preserve, restrict, disclose, or remove content or account information when we believe in good faith it is necessary to comply with law or legal process, investigate abuse, prevent serious harm, protect users or the public, or maintain the safety, security, and integrity of the Services.

We are not obligated to monitor all user behavior or content, but we may take action when we believe it is appropriate.

RetroLens offers two separate paid options: an optional auto-renewable subscription ("RetroLens Pro") and optional consumable "G7X AI Look" credit packs. These are separate products with different rules — buying credits is not a subscription, and having a subscription does not automatically grant credits.

a. RetroLens Pro subscriptions

Some features of RetroLens require a paid auto-renewable subscription. RetroLens Pro may be offered in different billing periods (for example, weekly, monthly, yearly, or other periods approved by the applicable store). The exact product, price, billing period, any free trial or introductory offer, renewal date, and included benefits are displayed by the App Store and in the purchase screen before you confirm.

If you purchase through Apple:

• payment is charged to your Apple Account at confirmation of purchase
• subscriptions automatically renew for the same period unless canceled at least 24 hours before the end of the current billing period, according to Apple's rules
• your Apple Account may be charged for renewal within 24 hours before the end of the current period
• you can manage and cancel subscriptions in your Apple App Store account settings (Settings → Apple ID → Subscriptions)
• if a free trial or introductory offer is offered, it will automatically convert to a paid subscription unless canceled before the trial or introductory period ends
• any unused portion of a free trial is forfeited when you purchase a subscription, where applicable
• trial and introductory-offer eligibility is determined by Apple and our subscription infrastructure provider, Superwall
• refunds are handled by Apple in accordance with Apple's policies and applicable law
• you can restore eligible prior purchases through the in-app "Restore Purchases" option

Where RetroLens is made available on Google Play, subscriptions and refunds are handled by Google under Google's applicable rules and policies.

Access to RetroLens Pro features depends on a verified entitlement delivered through Apple (or Google, where available) and Superwall. Access to paid features may be delayed, interrupted, or temporarily unavailable if the store, Superwall, network connectivity, or entitlement verification is unavailable, degraded, or returns an unexpected response.

Deleting the app or deleting your RetroLens account does not cancel your store subscription. You must cancel in your Apple App Store account settings (or Google Play, where available).

b. G7X AI Look credits (consumables)

G7X AI Look credits are consumable digital items, not a subscription. Credits are purchased in packs through Apple In-App Purchase (and, where available, Google Play) and are used to run additional G7X AI Look processing.

• One AI Look currently consumes 50 credits. The number of credits per AI Look and the credits included in each pack may change; the current values are shown in the app and in the store before you confirm a purchase.
• RetroLens currently offers one free AI Look allowance per day to eligible authenticated users. This free allowance may be changed, limited, or removed at any time.
• Store pricing for credit packs is set through the store and may change. Current pricing is shown by the store and in the purchase screen before you confirm.
• Purchased credits remain in your account until they are used, refunded, reversed, removed due to fraud or a chargeback, or deleted along with your account.
• Credits do not renew automatically.
• Credits do not grant, extend, restore, or convert into a RetroLens Pro subscription.
• Credits have no cash value, do not earn interest, and cannot be transferred, gifted, sold, or exchanged between accounts.
• Consumables are not restored in the same way as subscriptions. However, an unused server-recorded credit balance may become available again when you sign back into the same RetroLens account.
• Refund eligibility and processing are controlled by Apple, Google, applicable law, and the relevant store's policies.
• We may correct duplicate, fraudulent, refunded, reversed, or technically erroneous credit grants.
• When we can verify that an AI processing attempt failed, we aim not to permanently consume a paid credit for that failure. We do not promise that every dispute can be resolved automatically.
• Purchasing credits does not guarantee any particular creative result. See the "G7X AI Look" section above.

c. Changes

We may change pricing, features, subscription periods, credit values, free-allowance amounts, or offerings at any time, to the extent permitted by law.

Your use of RetroLens is also governed by our Privacy Policy.

If you download RetroLens from the Apple App Store, you acknowledge that:

• these Terms are between you and Banana Apps LLC, not Apple
• Apple is not responsible for the Services or their content
• Apple has no obligation to provide maintenance or support for the Services except as required by applicable law
• in the event the Services fail to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Services
• Apple is not responsible for addressing claims by you or any third party relating to the Services or your possession or use of the Services, including product liability claims, claims that the Services fail to conform to any legal or regulatory requirement, and claims arising under consumer protection or similar legislation, except as required by law
• in the event of any third-party claim that the Services or your possession and use of the Services infringe that third party's intellectual property rights, Banana Apps LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of that claim, to the extent required by these Terms
• you represent that you are not located in a country that is subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and you are not listed on any U.S. Government list of prohibited or restricted parties
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you

Where RetroLens is made available on Google Play, your download and use are also subject to Google Play's applicable terms and policies. Nothing in this section implies that RetroLens is currently available on Google Play if it has not launched on that platform.

If you believe content on RetroLens infringes your copyright, contact us at team@getbananaapps.com with:

• your name and contact information
• a description of the copyrighted work you believe has been infringed
• the specific content on RetroLens you believe is infringing, with enough detail for us to locate it
• a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law
• a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf
• your physical or electronic signature

We may remove or restrict content we believe in good faith infringes copyright, and we may terminate the accounts of repeat infringers.

You may stop using RetroLens at any time and may delete your account from within the app (Settings → Account → Delete Account).

Account deletion removes the active RetroLens profile and associated account-scoped information — including posts, private memories, friendships, comments, reactions, saves, blocks, reports, in-app notification records, AI-processing jobs, and the RetroLens-side AI credit balance and grant records — subject to legitimate legal, safety, fraud-prevention, transaction, backup, and technical-retention requirements. Deleting your account can permanently forfeit any unused AI credits associated with that RetroLens account, except where applicable law or a store-approved refund requires otherwise.

Deleting your RetroLens account does not cancel an Apple App Store or Google Play subscription. Your store subscription will remain active until canceled through the store.

We may suspend, limit, or terminate your access to the Services at any time if:

• you violate these Terms
• we believe your use creates risk, harm, abuse, legal exposure, or security issues
• we are investigating suspected misconduct
• we discontinue some or all of the Services

Sections that by their nature should survive termination will survive, including provisions related to ownership, licenses, disclaimers, limitations of liability, indemnification, payments, dispute-related provisions, and safety enforcement.

You are solely responsible for the content you post and for making sure you have the rights and permissions to share it, including any rights of people who appear in your photos. You are responsible for your conduct on RetroLens, your interactions with other users, and for keeping your account and device secure.

RetroLens is a private social photo app. It is not designed or intended for emergency communication, safety monitoring, time-sensitive alerts, medical use, or any situation where failure or delay could result in injury, loss, or other harm. Do not rely on RetroLens for any of these purposes.

To the fullest extent permitted by law, we are not responsible for the loss, deletion, corruption, or unavailability of photos, posts, private memories, saved items, comments, reactions, AI source images, AI-generated results, or other content stored on your device or in our cloud infrastructure. You are responsible for keeping your own backups of any content that is important to you.

RetroLens is not a backup service. RetroLens is not intended to be your only copy, backup, or archival storage for important photos or other content. Please keep independent copies of anything you cannot afford to lose.

If you participate in TestFlight, beta programs, early access, or other pre-release versions of RetroLens, you understand that those versions may contain bugs, incomplete features, instability, crashes, or data loss, and may change or be discontinued at any time without notice. Pre-release versions are provided "as is" with no warranty.

We may use automated systems to help operate RetroLens — for example, to surface friend activity, personalize app surfaces, detect spam or abuse, filter objectionable text in usernames, bios, or comments, improve reliability, or apply camera and photo effects. We do not use your private photos to train public AI models.

RetroLens is provided on an "as is" and "as available" basis. We do not guarantee that photos, posts, reminders, social features, or any other part of the Services will always be available, error-free, secure, or uninterrupted. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, and accuracy.

To the fullest extent permitted by law, Banana Apps LLC and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of data, photos, profits, revenue, goodwill, or business opportunities, arising out of or related to your use of the Services.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Services will not exceed the amount you paid us, if any, in the 12 months before the claim arose.

You agree to defend, indemnify, and hold harmless Banana Apps LLC and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• your use of the Services
• your User Content
• your violation of these Terms
• your violation of any law or third-party rights

We may modify the Services or these Terms from time to time. If we make material changes, we will provide notice through the app, the website, or other reasonable means and update the Effective Date above. Your continued use of RetroLens after the updated Terms become effective means you agree to the updated Terms.

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles, except where applicable law requires otherwise.
